Canada orders deportation of female U.S. soldier

TORONTO (Reuters) - The first female U.S. soldier to seek refuge in Canada rather than return to duty in Iraq is facing deportation, a group that advocates for her said on Thursday.

Kimberly Rivera, a 30-year-old private who served three months in Iraq and came to Canada while on leave in 2007, has been ordered out of the country, said Michelle Robidoux, spokeswoman with the War Resisters Support Campaign.

"She developed an opposition to what was going on in Iraq based on her experience in Iraq," Robidoux said.

Rivera, who has been living in Toronto with her partner and four children, could face jail time in the United States.

She was denied refugee status, but a federal court struck down an earlier deportation order. That forced immigration authorities to reconsider her removal, but after doing so they again ordered her to leave.

Rivera might still avoid deportation. Robidoux said Rivera has applied to stay in Canada on humanitarian and compassionate grounds, and that application is still pending.

In exceptional circumstances, applicants can be granted residence in Canada based on how settled they are, family ties in the country, the welfare of children involved or what might happen to an applicant if they are not allowed to stay.

During the Vietnam War, Canada was a haven for tens of thousands of draft dodgers and deserters, but soldiers from Iraq, who were volunteers, have been met with little sympathy from the federal government.

Rare find: Feathered dinosaur feasts on flying food

University of Alberta researchers found evidence that a feathered, but flightless dinosaur was able to snag and consume small flying dinosaurs.

The U of A paleontology team found the fossilized remains of three flying dinosaurs in the belly of a raptor-like predator called Sinocalliopteryx. Sinocalliopteryxwas about two meters in length and roughly the size of a modern-day wolf.

Sinocalliopteryx's flying meals were three Confuciusornis. Confuciusorniswas one of the earliest birds and had a crude version of a modern bird's skeleton and muscles. The researchers say such primitive birds were probably limited to slow take-offs and short flights.

According to the researchers, this is the first time a predator has been linked to the killing of multiple flying dinosaurs.

Scott Persons, a U of A paleontology student and research coauthor, says Sinocalliopteryx may have used stealth to stock the flyers. "Sinocalliopteryxdidn't have wings or the physical tools needed to be an adept tree climber," said Persons.

Persons explains Sinocalliopteryxhad feathers or hair-like fuzz covering its body creating a level of insulation that helped maintain a warm body temperature and high metabolism that required a lot of food to fuel.

"The fact that this Sinocalliopteryxhad, not one, but three undigested birds in its stomach indicate it was a voracious eater and a very active hunter," said Persons.

This find was made in China's Liaoning province, and U of A researchers analyzed stomach contents of a second Sinocalliopteryx fossil discovery from that area. The researchers identified this Sinocalliopteryx's last meal as a Sinornithosaurus, a small feathered meat-eater about the size of a house cat that may have been able to fly or glide short distances.

"Sinornithosaurus is a relative of Velociraptorwhich means this is the first direct evidence of a raptor becoming another predatory dinosaur's meal," said Persons.

I am an east coast gal. I was born in Portsmouth, New Hampshire and raised in Wells, Maine. I visit York, Maine often, it has always been one of my favorite places because it is part of the route ?home.? When I think of why I love the coast of Maine, York is always one of the reasons.?

Recently the George Marshall Store Gallery contacted our business to be apart of the exhibit Accord VIII: A Pairing of Antiquities and Contemporary Art. Up until this point I had never visited the gallery, only heard great things about it. Before working with the museum I went to the site and was amazed. I had no idea the amount of history that existed on this very piece of property. The museum is truly a gem. The seaside setting is the icing on the cake. To smell fresh salty air while looking at art and antiques is what the tourists dream of and the ?Maine-rs? sometimes take for granted.?

I am a second generation antique dealer. I have been apart of 7 major exhibits since I joined the family business. This was the first that I was apart of where a pairing of contemporary art and antiquities have taken place in the same setting. I was both nervous and excited. As a 30 year old woman I realize that my generation and my parents generation have different taste. Much like fashion, mixing and matching is what makes the ?outfit.? And, history always has a funny way of repeating itself. As someone who loves both fashion and music I believe in the power of influence. Where that influence takes you, is ultimately up to you.

No matter what your age, to see how contemporary art and antiques influence each other in the same environment is amazing. They don?t fight or compete they simply exist in the same space together as if it was a relationship that eventually was meant to be. Finding the connection is all apart of the experience. To see how opposites attract and how influence can start is truly beautiful.

The phrase ?what is old is new again? comes to mind. The future is about making it all work, buying what you like and finding the relationship with your art, antiques, home and yourself.? Always remember, good taste transcends through time and never goes out of style.?

GOP chairman says party needs to 'prosecute' Obama

TAMPA, Fla. (AP) ? The chairman of the Republican Party says the GOP needs to "prosecute the president," arguing that Barack Obama's offenses are a long list of promises unfulfilled.

Reince Priebus (ryns PREE'-bus) says Obama promised lower unemployment if Congress passed his stimulus package in 2009. He said the president also pledged to reduce both the federal deficit and the nation's debt. The unemployment rate stands at 8.3 percent.

Priebus said in an interview Monday with "CBS This Morning" that the GOP needs to prosecute the president "who seems to be in love with the sound of his own voice."

Other Republicans declined to use the word "prosecute."

Former New Hampshire Gov. John Sununu faulted Obama for what he said is a failure of leadership.

(AP) ? Republicans staged a remarkably subdued opening to Mitt Romney's national convention Monday in the midst of a turbulent election year, wary of uncorking a glittery political celebration as Tropical Storm Isaac surged menacingly toward New Orleans and the northern Gulf Coast.

There was speculation that the Republican man of the hour would make an unannounced visit to the convention hall Tuesday night when his wife, Ann, was on the speaking program. The campaign would confirm only that he was flying to town in time to do so.

Virtually every party leader spoke somberly of the storm's potential damage during the day, including the candidate. "Our thoughts are with the people that are in the storm's path and hope that they're spared any major destruction," said Romney, the man seeking to defeat Democratic President Barack Obama.

Though Republicans are intent on turning the campaign's focus back to the nation's sluggish economic growth and high unemployment, a comment Romney made on abortion reintroduced a topic that had taken over campaign discussion last week. In a CBS interview, he said he opposes abortions except "in the case of rape and incest, and the health and life of the mother."

That underscored his difference of opinion on the subject with his running mate, Rep. Paul Ryan of Wisconsin, as well as with his own convention platform, which opposes all abortions.

Any exceptions made solely on the basis of a woman's health have drawn particularly fierce criticism from abortion foes for years, and Romney's aides said he wasn't advocating an exemption on that basis alone.

"Governor Romney's position is clear: He opposes abortion except for cases of rape, incest and where the life of the mother is threatened," said Andrea Saul, a spokeswoman.

The convention's first session lasted scarcely a minute, just long enough for the party's chairman, Reince Priebus, to rap a gavel and declare the gathering open for business. As he did, high above the floor, numbers began flashing across an electronic tally board labeled "Debt from Convention Start," meant to show the government steadily borrowing under Obama's leadership throughout the convention.

The week was turning out to be about both meteorology and politics. Romney's top aides and convention planners were juggling their desire for a robust rouse-the-Republicans convention with concern about appearing uncaring as New Orleans faced a threat from Isaac precisely seven years after the city was devastated by Hurricane Katrina.

Forecasters predicted Isaac would intensify into a Category 1 hurricane by Tuesday with top sustained winds between 74 and 95 mph, and said its projected path went through New Orleans.

Opinion polls made the presidential race nearly even as Republicans launched their convention, although it appeared Obama had a slim advantage in battleground states where the election is most likely to be decided. It was anything but certain what the impact would be on the campaign of back-to-back convention weeks, first Romney's and then the president's in Charlotte, N.C.

The economy is the number one issue by far in the polls, and Romney's surrogates sought to make sure the campaign focus stays fixed on it.

A blunt view came from Gary Hawkins, a delegate from Brandon, Miss. "We have to nominate a candidate for president. Our mission is to save America from becoming a socialistic state," he said.

In the convention hall, Priebus looked out at thousands of empty seats and a smattering of delegates in his brief turn on stage. Officials decided earlier in the week to scrap nearly all of the opening day's program when it appeared that Isaac might make a direct hit on the convention city.

That put Romney's formal nomination off by a day until Tuesday. Weather permitting, he delivers his acceptance speech on Thursday night, then embarks on a fall campaign that he hopes will propel him to the White House.

Romney's wife, Ann, is on the speaking program for Tuesday evening, and it wasn't known if he intended to be in the hall for her address.

"This week is about convincing the 10 percent of undecided voters that Romney has always been called to come out and fix broken organizations," said Sen. Roger Wicker, R-Miss., interviewed on the convention floor.

"We've got to make the case that he is uniquely qualified in this hour" he said, adding that the "country is in bankruptcy."

Sen. Rob Portman, R-Ohio, carried a similar message to his state's delegates at a morning meeting.

"It's time to stop blaming others and take responsibility," he said in a reference to the president. "There are families all over Ohio that are suffering as a result. He hasn't measured up to his own standards. "

What passed for vocal dissent within the party came from supporters of Rep. Ron Paul, a Texas Republican who ran for the presidential nomination but failed to win a primary or caucus.

Delegates loyal to him threatened a floor fight later in the week over party rules. And they staged a brief but noisy demonstration at the rear of the convention hall after Priebus completed his brief turn at the podium, holding up placards bearing their man's name. They stood in front of a permanent sign that said "We Can Do Better," appropriating Romney's pledge to fix the economy to express a preference for their man.

More than dissent, there was concern from within the party, though couched in supportive terms, that despite the political opportunity that the weak economy presents, Romney needs to broaden GOP appeal.

"This is Romney's threshold moment. He must demonstrate that he would follow the example of other Republican presidents in addressing issues important to women," Sen. Olympia Snowe, R-Maine, wrote in The Washington Post, one of several party leaders to express the view.

Not that Obama and his surrogates were letting up on that subject.

In a tweet on Monday night, Obama circulated a quotation from Women's Health Magazine suggesting that Republicans would take away women's right to contraception. "Crazy as it sounds, the fight to limit or even ban birth control is a key issue in the upcoming presidential election," it said.

That was in addition to a controversy that combined rape and abortion that was triggered when the Republican candidate for a Missouri Senate seat said a woman's body has a way of preventing pregnancy in cases of "legitimate rape." Rep. Todd Akin, who opposes abortions without exception, quickly apologized for his claim, which is unsupported by medical evidence, but refused to get out of the race as Romney and other leading Republicans requested.

Polls testified to the political stakes.

An AP-GfK poll of registered voters conducted from Aug. 16-20 showed Obama leading Romney by 50-44 among women. That represented a narrow closing of the gap by the Republican from a survey in May, when the president led 54-39 among female voters.

Romney trailed badly among another key group. A Gallup poll taken between July 30 and Aug 1 showed Obama winning 60 percent support among Hispanic voters, and the Republican at 27 percent, little different from 64-29 earlier in the year.

Among seniors, the group most affected by a Medicare debate that looms as central to the campaign, Romney led Obama by a margin of 52-42 in the recent AP-GfK poll. That was compared with 53-40 in May.

In Tampa, despite weather worries, Tom Del Beccaro, a California delegate and chair of the state GOP, predicted the one-day delay in full convention events would supercharge the rest of the week's meeting.

"I think there's going to be a lot of bottled up energy, and I think that's going to show," he said.

But Sally Bradshaw, a Florida Republican and longtime senior aide to former Florida Gov. Jeb Bush, was more cautious. "It's a mess all around and it's fraught with risk," she said. "It's not good for anybody ? particularly the people impacted by the storm."

Vice presidential candidate Paul Ryan, speaking in his hometown of Janesville, Wis., before heading for the convention on Tuesday, said the stakes were as high as could be.

"We're not just picking the next president for a few years," he said. "We are picking the pathway for America for a generation."

In the streets surrounding the convention hall, police vastly outnumbered protesters.

There was one arrest, a man who refused to remove his bandana after a march through downtown.

Samsung?s crushing loss in patent trial won?t impact parts deal with Apple

Samsung (005930) was hit extremely hard last week when a jury determined that 21 of the company?s various Android devices infringed on various combinations of six Apple (AAPL) patents. Some industry watchers suggested justice had been served, but Samsung obviously disagrees and plans to appeal the ruling. While Apple clearly isn?t on the South Korean electronics giant?s list for holiday gift baskets this year, Reuters reports that the verdict will likely not have any impact on business pertaining to components that Apple purchases from Samsung for its various devices. Apple is currently Samsung?s biggest customer in terms of its parts business, which is estimated to pull in $13 billion in revenue next year. ?The clear message from Samsung is that a strict internal firewall between its handset business and its components operations remains intact,? Reuters reporter Miyoung Kim wrote following word from an emergency meeting Samsung executives called on Sunday. According to the report, Samsung?s chips and other parts account for 26% of the component cost of Apple?s iPhone.

Once upon a baby shower?

Today was a happy day.

I drove to Orlando to celebrate the pending arrival of baby Lexi.

Hard to believe it?s been two years since I attended the wedding of Christie and Mat, or that they are now expecting their first baby. Where does the time go? I?m so happy for both of them. They are going to be wonderful parents, Lexi doesn?t know just how lucky she is. :)

It was almost like a mini-elementary-school reunion at the shower. Can you believe I?ve known some of these girls for 20+ years?!

Aimee was in the same kindergarten class with my brother, Christie and I met in sixth grade, Shannan and I go back to fifth grade, and Kira and I were both in Mrs. Perry?s kindergarten class. My pre-teen and teen years were filled with Friday night movie dates (where our parents dropped us off and we enjoyed a $1.25 slice of pizza before hand), sleep overs galore, shopping adventures, and so much more ? all with this group of girls. They are my oldest group of friends and I only wish I got to see them more.

The shower was lovely. Christie?s mom did a wonderful job putting the party together.

More parents of special-needs children opt out of ... - Education News

For thousands of Texas parents, the start of the school year has taken on a new meaning: an end to the conflicts, struggles and disappointment with the public school system.

A growing number of parents of special-needs children are opting out of public schools, deciding instead to home school or to pay for pricey private schools.

The number of secondary students who left public schools to home school increased 50 percent from 2003 to 2010, reaching 2,040 7th- through 12th-graders, according to the Texas Education Agency. The number of middle- and high-school special education students who withdrew for private school increased 75 percent, reaching 772 in 2010.

That?s not to mention thousands of younger students whose reasons for leaving public schools aren?t recorded, or the countless families who give up on public school before their child receives a needed ?special education? classification. With Texas? diagnosis rate falling to an all-time low of 8.8 percent in recent years ? the lowest in the nation ? the label and its accompanying services are harder than ever to come by.

?It?s the free market at work. People are voting with their feet,? said Tim Lambert, president of the Texas Home School Coalition. ?Parents just get frustrated with the bureaucracy of the public school.?

A record 300,000 Texas children are being home-schooled, and an increasing number of them have special needs, prompting the creation of support groups and specialized curriculum. Some families who don?t feel equipped to handle home-schooling a child with special needs search out one of the dozens of specialty private schools, often paying the equivalent of Ivy League tuition.

Leslie Phillips pulled her son out of a Katy school when he was in second grade, opting to pay a $30,000-a-year tuition bill rather than continue fighting for the services she felt he needed. The family viewed tuition as a better investment than a legal battle they were unlikely to win. To add urgency, her son, who has an autism disorder, was coming home with bruises that no one could explain.

Lack of resources

?They just didn?t or couldn?t respond quickly enough to get us in a situation that was safe for him,? said Phillips, whose son, now 12, is thriving at a private school. ?I have probably more sympathy for school districts than many parents. ? They?re left with this explosion of children with a high level of need and they can?t scramble fast enough to get the resources and training.?

Considering the autism and attention deficit-hyperactivity disorder epidemics, Texas? shrinking number of special education children seems questionable, she added.

Some education officials, however, argue the decline is a positive sign that public schools are identifying and remediating learning disabilities faster, reducing the need for special education.

Cynthia Singleton home-schooled her son, who has autism, for several years before enrolling him in Johnston Middle School in the Houston ISD, where he?s an eighth-grader in advanced classes. It?s the lack of attention to the social needs of special education students that will likely leave her scrambling for alternatives for high school.

?They don?t have even half of the resources they need to handle the kid with disabilities,? she said. ?They turn a blind eye to the social needs.?

A niche group of lawyers defends school districts against parents? special-education legal claims, making it difficult for parents to prevail without spending considerable time and money.

?Find an alternative?

?When you get into a fight with a school, it?s like a divorce,? Singleton said. ?I?d rather take my energy and money and find an alternative.?

Claudia Wanczyk pulled her son out of Katy ISD when he was rezoned to a different school with a new teacher at the start of fourth grade. The family has spent thousands of dollars on therapy in addition to home-schooling the 12-year-old.

?He?s made more progress? at home, she said.

Rebecca Rex?s son is starting Lone Star College this month after being home-schooled throughout K-12. She showed up for kindergarten registration 15 years ago intending to enroll him in public school, but she had immediate concerns about administrators? reaction to her son, who was born with lead poisoning.

Rex?s son is now an avid photographer and a skilled swimmer. He?s well traveled and a talented artist.

?It just became a way of life for us,? she said. ?I guess I?m happy the school system ran me off, to be honest.?

Finding A Balance Between ?Being Yourself? And ?Being In A - Blog

If ?being yourself? takes up so much of your time, focus, and energy that you don?t have enough time to reasonably consider or do enough things for any potential romantic?partner, then partnering may not be in the cards for you.

If you were to try to calculate how much time each day you have after you take all the time needed to do all the direct and indirect things it takes to ?be yourself,? then how many hours each day might you have to take care of the needs of a partner?

There are some single people who have time for another person.? There are some single people who don?t have enough hours in the average day to take care of their own needs.

I?ve lived in households run by single parents and I?ve lived in households run by couples.? In my limited experience, the single head of households tended to be as busy or busier than the couples.? I remember thinking, ?This person has no time to be in a relationship ? even if they wanted to be in a relationship.? Between their jobs, housework, hobbies, pastimes, special interest groups, and community activities, they have no time for another person in an intimate relationship.?

If you?re a single person, and you make your life so busy you don?t have daily time for another person, then understand it is much less likely you will couple up.? This is not rocket science.

If you?re a single person, and you think you?d prefer to be in a couple, then maybe one of the first things to do is to look at your priorities and how you spend your time, and clear up some regular space in your schedule.? For example, if you don?t have an hour or two each day to socialize or use other methods to filter through and maybe find a potential partner ? then you may not have enough time in your regular schedule for a partner.

And if creating an hour or two each day in your schedule is an unpleasant prospect (because you so love everything else you?re already doing), then maybe that might be?a happier path for you ? remaining single and focusing more on yourself.?

If you prefer working for your church, singing in the choir, and being a part of a Bible study 4 or 5 days a week, then maybe you practically won?t have enough time to care for the needs of another complex human being in a nurturing relationship.

If you prefer reading?a few books a week, rather than facing the regular conflicts and work that come from caring for another human being, then maybe coupling is not your preference.

If you prefer watching football all weekend, playing a role-playing game a couple of hours each night, or spending most weekends camping, then maybe, when combined with all your other activities, work, and responsibilities ? you won?t realistically have enough daily time to be mindful of another person?s wants and needs.

The alternatives are always very good things.? To repeat:? The alternative activities to being in a relationship are almost always really healthy, good, and?pleasant things:? playing games, watching TV, surfing Facebook, bowling league, a great career, or raising a house full of pets.? It?s not that any one of these things is a negative by itself?- it?s that in the aggregate, when all combined, if you do all of those activities regularly ? you may not have enough time to regularly take care of the emotional and social needs of another human being.

There?s nothing wrong with preferring to be single and preferring to spend your time ?being yourself.?? But if you want to be in a relationship, you may benefit from re-examining what ?being yourself? means in the context of making enough regular time to care for another person?s sexual, emotional, bonding, conversational, and many other related needs.

I remember living in households run by single women and thinking:? The problem is not that she can?t find Mr. Right.? The larger problem is:? If she?found Mr. Right, she?d wouldn?t have?time for him.

I?m told from time to time that different strokes work for different folks.? I?ve heard some people theorize that people should remain distinctly individual and separate while being part of a couple.? Leo Buscaglia, a 1980s ?love? guru who once had 5 books simultaneously on the New York Times Bestseller List (but if you read?his?Wikipedia stub, you might think his work is already largely forgotten),?used to talk about how?two people in a relationship?should be like two circles that overlapped?only partially (instead of overlapping completely or one circle being completely inside another).? With this mental construct, two people combined parts of their lives, while keeping most of their lives largely distinct, individual, and separate. ?I?ve?long thought geometric circle analogies, that tried to explain how couples should interact, sucked because of their static?oversimplification in only 2-dimensions.

It should be noted Leo Buscaglia never married and never had to personally show if his theories worked in practice.

In a healthy couple,?each person?is considerate and adaptive to the wants and needs of the other.

I?ve never observed someone who put their own wants and needs above their partner?s?to?be good at relationships.? I?ve seen several people who thought they could put their interests above their partner?s, and who thought they were still good at being a significant other,?repeatedly fail to keep their relationships together.? Some of these people would even?have been considered ?unselfish? or??very giving? people.

But terms like ?selfish? and ?giving? don?t?reveal enough.? Sometimes it?s selfish to meet the needs and wants of your partner.? Sometimes self-preserving drives are very healthy.? Sometimes it?s better to be selfish, because an intelligent selfishness should make it clear that in order to meet more of?your own interests, you might be smarter to meet the interests of the people close to you.? Sometimes it?s better to be intelligently selfish than it is to be charitably self-harming.? Sometimes, the self-benefiting motivations lead us to create better benefits for?others and ourselves.

When you become a partner to someone, you don?t just take on that person in a vacuum ? separate from the rest of their world.? Almost every person comes with a pre-existing social circle of friends and relatives.? When you take on a partner, then almost always, you take?on a great deal of interaction and interdependence with their social circle.

With some people who are less socially connected, this is less of a concern.? But for most socially pleasant and capable people, they come with a social circle.? So, often you?ll need to not only have enough time for your partner, you?ll often also need to make regular time to take care of their social community ? their parents, their children, and their social groups and activities.? It?s all connected.

An irony is:? If you want a really-capable?social partner, but you want them exclusively for yourself ? you?re looking for a combination that may not exist, because people who are really good socially almost always are very?connected to other socially-capable?people.? If you?re vision of ?couplehood? happiness involves taking up all of your partner?s time -?and not having to interact with their social circle ? that combination may rarely exist.? If meeting your needs requires?your partner?to exclude their social circle ? that almost always creates conflicts.

Instead of complaining that we do not live in a mansion, how about thanking our families for providing a roof over our head? Appreciating the small things in life is the key to achieving big thins.

Tip #3: Keep positive company

The company we keep plays a key role in our thoughts. If you are always in the company of people who are always complaining and criticizing you are likely to become like them. No wonder the saying ?birds of a feather flock together?. You should therefore watch your company at all times.

Tip #4: Have goals

You must know what you want to achieve in order to help yourself. We should set realistic goals especially when it comes to our financial status. Once you have your goals you will need to work hard and be disciplined in order to achieve them. In addition, you can motivate yourself by rewarding your efforts.

Tip #5: Take a break

Canada's crude on the rails

North American rail shipments of crude oil are estimated to have grown by 360,000 barrels per day within the past 12 months to reach 465,000 bpd ? equivalent to the addition of a major pipeline, according to First Energy Capital Corp., or 4% of total North American oil production

Anxious about pipeline capacity, Southern Pacific Resources Corp. (STP) recently threw its full weight behind rail, committing to transport its entire output through Canadian National Railway Co. and its partners.

While rail companies have seen roaring business from their crude-by-rail operations in the past few years, no other oil producer before had committed its entire bitumen output to CN long term, completely bypassing pipelines. It certainly put a dent in the theory that crude-by-rail is a temporary business.

Howard Bolinger, chief financial officer at STP, cites ?future risk of pipeline capacity availability? in Alberta as one of the reasons for the deal.

Under the contract starting in the fourth quarter, the Calgary-based producer plans to truck 12,000 barrels per day from its McKay plant to CN?s terminal in Lynton, Alta., from where it will head south 4,500 kilometres to a terminal in Natchez, Miss. It will then be hauled on barges to Gulf refineries.

STP?s transportation bill will be a whopping $31 per barrel, according to company estimates, but it will still manage higher netbacks ? or revenue minus total cost per unit ? of an additional $18 compared to pipelines as it will fetch Brent prices. The company will also save on diluents as, unlike pipelines, heavy oil transported on railways does not need to be blended with condensate. It typically costs $8 to transport a barrel of oil by pipeline.

STP?s long, multi-transport haul highlights the industry?s desperation to access the market in the face of severe environmental, political and aboroginal opposition to new pipeline proposals at a time when Western Canadian oil production is soaring.

Mr. Bolinger say there will be differential pressures for at least the next couple of years to make rail economical for the company. Brent was trading Thursday at US$114.62 per barrel, compared to WTI?s US$96.01 and Western Canada Select?s US$82.89, highlighting the disconnect between the various benchmarks.

?The reason why the rail market exists for crude oil is not that rail is cheaper than pipeline ? it?s because of the spread in the crude market between Brent-based pricing and WTI pricing,? says Mark Hallman, a CN spokesman. ?For light crudes, rail helps producers access markets that are not pipeline-connected and provides them with waterborne (Brent) netbacks.?

But Mr. Bolinger says the company may continue to look favourably on rail even if the proposed pipelines see the light of day. ?It may be part of our long-term strategy, however, we will continue to evaluate this on an ongoing basis.?

Calgary-based Baytex Energy Corp. also says it?s mitigating its exposure to WCS differentials by transporting some of its 38,500-barrel daily heavy-oil output to higher value markets by railways.

?We are currently delivering approximately 27% of our heavy oil volumes to market by rail and expect to increase rail deliveries to approximately 35% to 40% of our heavy oil volumes by year-end,? the company said in its second-quarter filing.

As a sign of the increasing importance of rail to the energy industry, the Calgary-based energy investment firm initiated coverage on rail companies.

?Just as it was over one hundred years ago, knowing the rail business has become vital to the energy business, and this is why FirstEnergy has initiated coverage of CP and CN,? analyst Steven I. Paiget wrote in an Aug.16 note.

While most oil companies remain reluctant to lock themselves into long-term contracts with rail companies, Canadian Pacific Railway Ltd. and CN are starting to get used to the business and even making investment commitments. CP, which had earlier estimated it would deploy 70,000 carloads to transport oil by 2014, now expects to reach that target a year earlier. The company also has the only direct railway between Calgary and Vancouver.

Meanwhile, CN moved approximately 5,000 cars of crude oil last year and expects to shift more than 30,000 oil-laden carloads in 2012, and has opened terminals in Alberta and Saskatchewan.

The two rail giants are expanding their energy portfolio to include frac, or drilling, sand and have signed deals with sand processing companies over the past few months.

CP has a ?line of sight? to 80% of a targeted $400-million of incremental annual energy revenues, including oil by rail, frac sand, drill pipe and other construction materials.

?We?re going to grow at two times GDP in those markets,? Jane O?Hagan, CP?s executive vice-president and chief marketing officer, told analysts on a second-quarter earnings call.

CN, which benefits from exclusive access to the Alberta oil sands and B.C. Montney gas fields, is investing $35-million to upgrade a 64-kilometre track in northern Wisconsin to move frac sand from a processing plant to shale drilling areas across the United States and Western Canada.

?Over the last three years, CN?s frac sand market has grown nearly 70%, reaching 35,000 carloads and $100-million in revenue in 2011, and we hope that our end-to-end service focus will help us grow this market to become a $300-million business in the next three-to-five year horizon,? says CN?s Mr. Hallman.

CP has invested $90-million to $100-million over the past two years to grow its energy supply chain and its customers are investing $400-million to $600-million in production and terminal facilities, according to FirstEnergy estimates.

If pipeline companies are worried about rail companies eating into their share, they are not showing it.

?Rail is a temporary option but not a long term one,? maintains Philippe Reicher, vice-president, external relations at the Canadian Energy Pipeline Association, which counts TransCanda Corp. and Enbridge Inc. as members.

But there is logistical trouble coming down the pipe: Even if the proposed pipelines are built on time, they won?t keep up with rising Western Canadian production and may effectively be full as early as 2014, says Andrew Potter, managing director, institutional equity research at CIBC World Markets Inc.

?Although the rail financial arbitrage will likely dissipate, we believe there is a permanent role for rail in the North American transportation mix,? Mr. Potter says. ?The advantage that many producers have observed is having more flexibility to reach different markets ? and that is a key offering of rail vs. pipelines.?
